Kathleen Kane (D), the sitting Pennsylvania Attorney General currently under indictment for alleged perjury and other charges, has long said that the source of her legal troubles is the ‘old boy network’ in state government. Her defense to allegations that she leaked secret grand jury testimony can be summed up as this whole thing started because two former prosecutors in the Attorney General’s Office didn’t want their porn habits at work exposed.

The former prosecutors are Frank Fina and Marc Costanzo. According to the Kane defense, “Faced with their imminent personal and professional disgrace and desperate to keep their wrongdoing secret, Fina and Costanzo devised a plot to block their obscene emails from being released to the public.”

What plot, you ask? Apparently, during the course of investigating why it took so long to indict convicted pedophile and former Penn State assistant coach Jerry Sandusky, Kane uncovered a slew of emails she hailed as pornographic and racist sent from and received by various state government employees.

Kane’s troubles began when an article appeared in the Philadelphia Inquirer alleging Kane shut down a criminal investigation later reopened by the Philadelphia District Attorney’s Office. Kane allegedly suspected Fina and Costanzo of providing the background information for the article to the Inquirer, though the indictment against Kane claims the investigation uncovered no such connection.

A few months later, an article criticizing a Fina and Costanzo investigation appeared in the Philadelphia Daily News. It was this article that spurred a request for a grand jury inquiry into the source of the information and ultimately Kane’s indictment based in part on her testimony before the resulting grand jury investigation.

Here’s where her defense gets murky. She’s apparently alleging that because Fina and Costanzo knew she was sitting on the emails, they orchestrated a scheme to discredit her by prompting the first article, which in turn prompted her to defend herself with the release of grand jury information for the subsequent article so that they could petition a judge for a new grand jury inquiry and request that the judge block the release of their email history. This sounds…complicated.

Now, the Pennsylvania Supreme Court has released a batch of emails that were contained in an earlier Kane filing in which she alleged that Fina and Costnaza misled the court by claiming they only wanted to block ‘personal email’ sent and received at work. The newly released emails were samples that Kane had attached to the filing. They include emails send and received by Fina, including “motivational posters” featuring nude women performing sex acts, an image of a white man running away from black men while clutching a box of Kentucky Fried Chicken captioned “Bravery at its finest” and doctored nudes of former presidential candidate Sarah Palin. If you want to look at all 400 pages, you will have to make a trip to Philadelphia, where the Pennsylvania Supreme Court has conveniently printed and placed them in a plain black binder.

Meanwhile, Kathleen Kane was bound over for trial following a preliminary hearing that included the use of her twin sister as a press decoy. Yes, that’s right. Kane has a twin. And that twin works in the Office of Attorney General. Of course, because this is Pennsylvania.
